Welcome to Skye Mountain Microgreens. By accessing or purchasing from our website, you agree to be bound by these Terms and Conditions, which govern your use of our website, products, and services. Please read them carefully.

1. General Terms

These Terms apply to all users, including browsers, subscribers, and customers, and remain in effect unless superseded by other agreements. Skye Mountain Microgreens can be contacted at support@skyemountain.co.uk.

  • We reserve the right to amend these Terms at any time. Changes take effect upon publication on our website. Continued use signifies acceptance of updated terms.
  • We may change, discontinue, or limit product availability or quantities. Errors or omissions (e.g., in descriptions or stock) will be corrected, and we’ll notify you of material impacts.
  • For questions or accessibility requests (e.g., alternative formats), contact support@skyemountain.co.uk.
  • Your personal data is handled per our Privacy Policy, compliant with UK GDPR and the Data Protection Act 2018. Cookies and tracking are governed by our Cookie Policy.
  • Payments are processed securely via Stripe or WooCommerce/Stripe integrations, and you may need to complete Strong Customer Authentication (SCA/3-D Secure). We do not store full payment card details. See Stripe’s Privacy Policy and your WooCommerce account settings for details.
  • Service emails/SMS: we’ll send order confirmations, service notices, renewal reminders and important updates to the contact details you provide. Please keep them current.
  • We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, strikes, carrier failures, government action, epidemics, supply chain disruptions).
  • Our website, GrowGarden™, MicroWick™, and related content are protected by intellectual property rights. You are granted a limited, revocable licence for personal, non-commercial use. Third-party trade marks remain the property of their respective owners. Automated scraping or bulk access is prohibited.
  • Products and services are sold to persons aged 18 and over and for consumer use (not resale).

2. Subscription Terms – Just Add Water Punnets

Our microgreen subscription plans (Pay As You Go, Annual contract, 3-month or 12-month paid in full) are billed per your selected plan, as shown at checkout.

  • You authorise recurring payments via Stripe until cancellation. In line with Stripe and WooCommerce standards, we’ll send a clear reminder before the next charge for any auto-renewing plan, and provide a straightforward cancellation route in one or two steps via your account dashboard or the Stripe Customer Portal.
  • Cancel via your account dashboard or by emailing support@skyemountain.co.uk with 30 days’ notice.
  • Pausing: you may pause for up to 3 months per calendar year. Shipments scheduled during a pause are skipped (not banked or accrued), and billing pauses accordingly. Pausing does not extend any minimum term linked to a discounted equipment bundle; minimum terms are measured in calendar months from your start date.
  • We recommend using punnets within 30 days of receipt for optimal seed vitality; this is guidance, not a condition.
  • If a variety is out of stock, we may substitute a similar variety unless you opt out via your account or email. If an unwanted substitution occurs, contact us for a suitable remedy.
  • Growing outcomes vary due to home conditions (e.g., light, temperature). We offer support via email, WhatsApp, or live chat.
  • Faulty or damaged punnets are replaced or refunded at no cost upon submission of photographic evidence after attempting support. Opened consumables (seeds and coco coir) are not returnable unless faulty, due to hygiene/perishability. Statutory rights apply.
  • If you cancel before the minimum term on a discounted grow system bundle, the discount applied to the equipment becomes payable.

3. Grow System Offers (Purchased Equipment)

GrowGarden™ systems (e.g., metal shelving and LED light panels) are available at the price shown at checkout or discounted with a qualifying subscription, subject to maintaining the subscription for the agreed term.

  • Warranty: In addition to your statutory rights, purchased equipment may include any manufacturer/supplier warranty provided with the product. No additional commercial warranty is provided by Skye Mountain Microgreens unless expressly stated. We’ll facilitate claims with the manufacturer/supplier where applicable.
  • Notify us of transit damage or shortages within 48 hours of delivery (please include photos of the packaging and item) via support@skyemountain.co.uk.
  • Unopened systems can be returned within 30 days for a full refund, provided all components and packaging are intact. We provide prepaid return labels for authorised UK returns; where you choose to arrange your own return, return postage and risk are yours until received.
  • Opened or used systems may be eligible for store credit, minus reasonable restocking/cleaning costs, following inspection. We’ll notify you of the assessment outcome within a reasonable time.
  • Risk passes to you on delivery; title passes when paid in full.
  • Safety: Use UK-approved equipment only. Use LED light panels and other electrical items in dry, ventilated conditions with the supplied/compatible adaptors. Do not immerse electrical components.

4. Accessories & Add-Ons (Purchased)

Accessories (e.g., LED light panels, USB fans, heat mats, spray bottles) are tested for quality and include any manufacturer/supplier warranty supplied with the product.

  • We will facilitate manufacturer/supplier warranty claims where applicable; contact support@skyemountain.co.uk to initiate.
  • Unopened accessories can be returned within 30 days for a full refund, in original packaging. Prepaid labels are provided for authorised UK returns.
  • Opened or used accessories may be eligible for store credit, minus reasonable restocking costs, after inspection.
  • Consumables (seeds and coco coir) are not returnable once opened unless faulty, for hygiene/perishability reasons. Statutory rights apply.

5. Payment, Billing & Delivery

You agree to pay the amount and billing frequency shown at checkout and in your order confirmation. Payments are processed securely via Stripe.

  • You authorise recurring payments for subscriptions until cancelled.
  • Prices are in GBP (£) and include VAT where applicable. You’ll be notified of changes before your next billing cycle.
  • Delivery is available across most of the UK, excluding certain remote areas (e.g., Highlands, Islands, Northern Ireland, Channel Islands). Any surcharges will be shown at checkout before you pay.
  • Delivery is typically estimated at 3–5 Business Days for UK mainland addresses via our chosen carriers. Tracking is provided when available. Where you authorise safe-place delivery, risk passes once the carrier records delivery to that safe place. Please report delivery damage or shortages within 48 hours.
  • Delivery is included with subscription plans unless stated otherwise. Rent-to-Own/Rent & Return equipment may incur delivery/collection charges shown at checkout.
  • Risk passes to you on delivery; title passes when paid in full (purchases only).

6. GrowGarden™ Rental Terms (Rent & Return / Rent-to-Own)

GrowGarden™ rentals include metal shelves (2- or 3-tier) and LED light panels (configurations of 2/4/8 panels). Consumables (seeds, coco coir) are excluded unless expressly stated.

  • Options:
    • Buy in Full: one-off payment for immediate ownership (outside this section).
    • Rent & Return: monthly rental with no minimum term; cancel any time by returning the equipment in good condition within 14 days of cancellation.
    • Rent-to-Own: ownership of the equipment (shelves and LED light panels supplied under your plan) transfers after 12 consecutive monthly payments; the rental then ends. Skipped/failed months reset the count.
  • Eligibility: UK residents aged 18+ with a valid payment method. No credit check is required; this is a consumer hire agreement, not regulated credit.
  • Billing: Payments start on dispatch or collection and continue monthly until cancellation, return, or ownership transfer.
  • Cancellation & Returns: Cancel via your account or support@skyemountain.co.uk. Return the equipment within 14 days in clean, working condition with all parts (including shelves, LED light panels, brackets, fixings and any supplied power/connection leads). We provide prepaid UK return labels for authorised rental returns; risk passes to us once handed to the carrier with our label. If you arrange your own return, you bear transit risk until received.
  • Condition & Cleaning: Fair wear and tear is acceptable. Excessive soiling or damage may incur reasonable reconditioning/replacement charges.
  • Loss/Damage & Charges: Reasonable charges may apply for missing or damaged parts (for example: shelves, LED light panels, brackets/fixings, cables, and if supplied as part of your rental kit: fan, heat mat, spray bottle). A non-return after the 14-day window may result in reasonable replacement charges; we may continue billing until the equipment is returned or paid for.
  • Non-Payment: If payments fail, we may retry multiple times over a 7-day period, then notify you, suspend the rental, and request return. We may take proportionate steps to recover unreturned equipment, including third-party agents and sharing data strictly for recovery purposes.
  • Cooling-Off (Distance Sales): Under the Consumer Contracts Regulations 2013, you may cancel within 14 days of receipt and receive a refund of rental payments made, minus return shipping where applicable (unless faulty). Handling beyond what is necessary to inspect may lead to deductions for diminished value.
  • Title & Risk: Until ownership transfers (Rent-to-Own), equipment remains our property. You agree to take reasonable care of it and not to sell or encumber it.
  • Safety: Use equipment indoors in dry, ventilated conditions. Do not immerse electricals. Follow all included safety instructions.

7. Community Giving

At checkout you may opt to donate the equivalent of a punnet to our UK community partners. Donations are triggered 30 days after payment provided the order is not cancelled or returned, and are aggregated and remitted on a quarterly schedule. We may amend or pause the programme; changes will not affect donations already committed.

8. Liability & Disclaimers

We are not responsible for environmental factors affecting plant growth (e.g., light, temperature, overwatering).

  • Information we provide is general nutrition/culinary guidance, not medical advice. Consult a healthcare professional before making dietary changes, especially if pregnant or managing medical conditions.
  • Our liability, whether in contract, tort or otherwise, is limited to repair, replacement or refund of defective products/equipment and capped at the amount paid for the product or relevant rental period, except that nothing limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights under the Consumer Rights Act 2015.
  • Use of products is at your discretion; we do not guarantee specific yields beyond reasonable expectations. Electrical items (e.g., LED light panels, heat mats) must be used with suitable UK-approved adaptors, kept dry and ventilated, and inspected regularly for cable damage.

9. Dispute Resolution

We aim to resolve concerns promptly.

10. User Content & Community

By submitting content (e.g., reviews or community posts), you grant us a non-exclusive, royalty-free licence to use, reproduce, display, edit for length/clarity, and moderate that content for promotional or community purposes within the UK, for as long as it appears on our services and for a reasonable archival period thereafter. To the extent permitted by law, you consent to editing and formatting changes.

  • You warrant that your content is accurate, lawful and does not infringe third-party rights. Prohibited content includes offensive, misleading, or infringing material. We may remove content at our discretion and operate a notice-and-takedown process via support@skyemountain.co.uk.

11. Governing Law

These Terms are governed by the laws of Scotland. Disputes are subject to the exclusive jurisdiction of the Scottish courts. If you live in England, Wales or Northern Ireland, you also retain any mandatory consumer protections of your local law. Your statutory consumer rights remain unaffected.
